Welcome to Kinky Brizzle. These Terms and Conditions (“Terms”) govern your use of our website at kinkybrizzle.com (the "Site") and your purchase of products from us. By accessing or using the Site, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Site.
Orders
All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, pricing errors, or suspected fraudulent activity.
You are responsible for providing accurate and complete information for your order, including shipping address, billing information, and contact details. Incorrect information may result in delivery delays or additional charges.
Pricing and Payment
All prices are displayed in British Pounds Sterling (£) and include Value Added Tax (VAT) where applicable. We reserve the right to change prices at any time without prior notice.
Payment is processed securely through our payment gateway. We accept major credit/debit cards and other secure payment methods. Your payment information is not stored on our servers.
Shipping and Delivery
We utilize print-on-demand fulfillment services. Products are manufactured and shipped directly from our fulfillment partners. Estimated delivery times are provided at checkout but are estimates only and not guarantees.
Shipping costs are calculated based on destination, package weight, and selected shipping method. These costs are clearly displayed during checkout before payment is processed.
Returns, Refunds, and Cancellations
Made-to-Order Products
As a print-on-demand retailer, all products are made to order specifically for you. Therefore, we generally do not accept returns, exchanges, or cancellations once production has begun, except in the cases outlined below.
Exceptions
We will accept returns or provide replacements only for:
- Products received damaged or defective
- Products that were printed incorrectly (wrong design, size, or color)
- Products that do not match what was ordered due to our error
Non-Returnable Items
Due to the custom, made-to-order nature of our products, we cannot accept returns for:
- Change of mind
- Incorrect size selection (unless we made an error)
- Preference changes
- Orders cancelled after production has started
Process
To request a return or replacement for eligible items, please contact us within 7 days of receiving your order with photographic evidence of the issue. We will review your claim and, if approved, provide a replacement at no additional cost or issue a refund to your original payment method.
Please note: We do not charge restocking fees. However, customers are responsible for return shipping costs unless the return is due to our error (defective, damaged, or incorrect item).
Intellectual Property
All content on this Site, including but not limited to text, graphics, logos, images, and software, is the property of Kinky Brizzle or its licensors and is protected by international copyright laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows: you may cache pages that are necessary to view another page, and you may print or download a reasonable number of pages for your own personal, non-commercial use, provided that you keep intact all copyright and other proprietary notices.
Limitation of Liability
To the maximum extent permitted by law, Kinky Brizzle shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Site; (b) any conduct or content of any third party on the Site; (c) any content obtained from the Site; and (d) unauthorized access, use, or alteration of your transmissions or content.
In no event shall Kinky Brizzle's total liability to you for all damages, losses, and causes of action (whether in contract, tort, including negligence, or otherwise) exceed the amount paid by you to us for the specific product or service giving rise to such liability.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in England and Wales.
Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
